DMCA Policy for The Emirates Medical Review

1. Introduction and Policy Statement

The Emirates Medical Review (“we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our website, https://www.theemiratesmedicalreview.com (the “Site”), that are reported to our Designated Copyright Agent identified below.

This policy is intended to guide copyright owners in utilizing the DMCA’s notification procedures and to guide our users on how to respond when their posted material is the subject of a takedown notice. 3. Procedure for Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Site, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing.

To be effective, the notification must be a written communication that includes the following:

  • Identification of the copyrighted work claimed to have been infringed. You must provide clear identification of the original work. This is necessary for us to verify the original work.
  • Identification of the infringing material. You must identify the material on our Site that you claim is infringing your copyrighted work. This must be done with enough detail so that we can locate it. The most effective way to do this is to provide the full URL of the specific page(s) on our Site where the material is located.
  • Information reasonably sufficient to permit us to contact you. This must include your full name, mailing address, telephone number, and a valid email address. We will use this information to communicate with you regarding your claim.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. This is your formal declaration that you believe an infringement has occurred.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This statement affirms the truthfulness of your claim and your authority to make it.

Please be aware that under 17 U.S.C. § 512(f), you may be liable for any damages, including costs and attorneys’ fees, if you knowingly and materially misrepresent that material or activity is infringing.

5. Our Response to a Valid Notification

Upon receipt of a complete and valid DMCA Takedown Notice, it is our policy to:

  1. Promptly remove or disable access to the allegedly infringing material.
  2. Notify the user, subscriber, or other content provider, if applicable, that we have removed or disabled access to the material.
  3. For repeat infringers, take appropriate action, which may include terminating the user’s account and access to the Site, as outlined in our Repeat Infringer Policy.

6. Counter-Notification Procedure for Users

If you are a user of our Site and you believe that material you have posted has been removed or disabled as a result of a mistake or misidentification, you may send a written Counter-Notification to our Designated Copyright Agent.

To be effective, a Counter-Notification must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled. Providing the original URL is essential.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your full name, mailing address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which The Emirates Medical Review may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

7. Our Response to a Valid Counter-Notification

Upon receipt of a valid Counter-Notification, we will:

  1. Promptly provide the person who filed the original Takedown Notice with a copy of your Counter-Notification.
  2. Inform them that we will replace the removed material or cease disabling access to it in ten (10) to fourteen (14) business days.
  3. We will replace the removed material and cease disabling access to it not less than 10, nor more than 14, business days following receipt of the Counter-Notification, unless our Designated Copyright Agent first receives notice from the person who submitted the original notification that they have filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on our system or network.

8. Repeat Infringer Policy

It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who are repeat infringers of the copyrights or other intellectual property rights of others. We maintain a system for tracking infringement notices and will take action against any user who is found to be a repeat offender.
